PERSONAL DATA PROCESSING POLICY

This document is to provide you with basic information about how we process and protect your personal data. It contains important information about why, when, how and what personal data we process, as well as providing contact information so you can ask us in more detail about the process, or exercise your rights. We collect and process your personal data in accordance with the relevant valid and effective legislation. Therefore, we take every precaution to prevent the misuse of any personal data that you may provide. We only process your personal data where there is a legal basis to do so.

1. Data about us

ME:LEGAL s.r.o., advokátní kancelář, ID No.: 180 21 956, with registered office at Jakubska 647/2, Stare Mesto, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague under file No. C 380280, is the direct controller of your personal data (hereinafter referred to as "we" or "ME:LEGAL").

2. What personal data do we process and why?

We process the following personal data about you:

  • name and surname
  • address details
  • contact details – especially email and phone number
  • billing information and bank account details
  • other information and data you provide us with

3. When do we process your personal data?

We process your personal data that you provide, or that is publicly available, in the following situations:

  • when we provide you with legal services
  • when you visit our website www.melegal.cz
  • when you communicate with us via our contact form, by phone, email, or through our social media profile
  • when you apply for a position with us

We process your personal data both manually (paper files) and automatically (in the form of electronic files when you contact us electronically). However, in each case, we take care to ensure that they are properly secured during processing.

4. For what purpose and for how long do we process your personal data?

4.1 Performance of the contract

In cases where we provide you with legal services, we process the personal and third party data (your employees, clients, etc.) that you provide. These data are processed while we provide you with legal services, and fulfil the obligations that arise during the provision of our legal services. Typically, this will include your name, surname, date of birth, birth number, VAT number, residential or registered office address, contact details for communication, account number and other data that you provide.

The legal basis for the processing is thus the performance of the contract. We retain the personal data for the duration of the contract, or provision of legal services, and for a period of ten (10) years from the end of our contractual relationship.

4.2 Solving your requirements based on contact

If you have contacted us via the contact form on the website, by phone, email, via our social media profile, or in any other way not mentioned, we process your personal data in order to fulfil the request. Typically, this will include your name, surname and contact details for communication.

The legal basis for the processing is thus the implementation of measures taken prior to the conclusion of the contract, at your request. We will keep the personal data in this way until your request has been processed, and for a further three (3) years.

4.3 Fulfilling legal obligations

ME:LEGAL is subject to a large number of obligations imposed by legal or statutory provisions. The obligation to process personal data is often linked to fulfilling these obligations. These include, for example, Act No. 85/1996 Coll., on advocacy, or Act No. 253/2008 Coll., on certain measures against the legalisation of the proceeds of crime. In fulfilling our legal obligations, we only process data that the relevant legislation requires us to process. Typically, this will include name, surname, date of birth, birth number, VAT number, address of residence or registered office.

The legal basis for processing is thus the fulfilment of legal obligations, and we store personal data for the period required by the relevant legal regulations.

4.4 Our legitimate interest

We may also process your personal data to protect our clients, other persons, or our  legitimate interests. Typically, this data will include your name, surname, date of birth, birth number, registration number, VAT number, residential or registered office address, contact details for communication, account number, and any other necessary data provided to us.

The legal basis for the data processing is therefore legitimate interest. We retain personal data for a period of three (3) years from the time the data processing commenced – unless otherwise provided for by the law (eg governing the practice of law) or unless there is a legitimate interest in processing the relevant data for a longer period (in particular case circumstances).

4.5 Carrying out recruitment activities

If you apply for employment or other forms of cooperation with us, we process the personal data that you provide during the selection process. Typically, this will include your name, surname, date of birth, birth number, home address, contact details for communication, details of your education and work experience and any other data you provide us with.

The legal basis for the processing is therefore the implementation of measures taken prior to your request to conclude the contract. We will keep the personal data for the duration of the recruitment procedure, for a maximum of three (3) months from the first contact, unless we subsequently have another reason for processing it further.

5. Who do we pass your personal data to?

In some cases, other persons may also process your personal data. In addition to public authorities, to whom we may disclose your personal data where required by law, we may also, when necessary, transfer your personal data to any reliable third party that provides services as our contractual partner. Such transfer is always carried out in accordance with the relevant provisions of the law, and secured by appropriate measures to protect your personal data.

In addition, if your personal data are handled by our employees or cooperating attorneys, they are strictly bound by confidentiality obligations, under the terms of the applicable legal and professional regulations.

6. What rights do you have in relation to your personal data?

In connection with the processing of your personal data, you have rights in accordance with the relevant legislation, which we will observe to the maximum extent possible. 

The rights are as follows:

  • Right of access to personal data – you have the right to ask us what personal data we process about you
  • The right to rectification of personal data – if you find that the personal data we process about you are not up-to-date or are incorrect, you can request their rectification
  • Right to erasure ("right to be forgotten") – at your request, we must erase any personal data we process about you. However, there may be other reasons that entitle or oblige us to retain that data (eg an obligation under the law), in which case we may not be able to erase it
  • Right to restriction of processing – until your complaint is resolved, you have the right to restrict processing if you contest the accuracy of the personal data, the reasons for processing, or if you object to our processing them
  • Right to data portability – You have the right to the portability of personal data relating to you in a structured, commonly used, and machine-readable format. This right applies to personal data that you have provided to us and that we process on the basis of your consent or contract. You also have the right to request the transfer of this data to another controller, if technically feasible. This right may be restricted if this would put the rights and freedoms of others at risk
  • Right to object – if you feel that we are processing your personal data beyond our legitimate interest, you can object to the processing. If we do not demonstrate that there is a compelling legitimate reason for the processing which overrides your interests or rights and freedoms, we will terminate the processing on the basis of the objection
  • Right to file a complaint – if you are dissatisfied, you have the right to file a complaint with the Office for Personal Data Protection, located at Pplk. Sochora 727/27, Holešovice, 170 00 Prague 7 (more at https://www.uoou.cz/)
